Drunk driver who struck pedestrian in Sussex County sentenced

NEWTON, NJ (Sussex County) – A Sussex County man has been sentenced after pleading guilty to assault by auto and driving while intoxicated, according to Sussex County Prosecutor Francis Koch.

Mark W. DiBattista, 62, of Branchville was sentenced before the Honorable Michael Hubner, J.S.C. on June 17, Koch said.

DiBattista was sentenced to 180 days in the county jail and he must successfully enter and complete the Drug Court Program, pay $1023.45 restitution to the victim and court fines and fees, Koch said.

DiBattista was intoxicated while operating his motor vehicle and struck a pedestrian outside the Hampton Township Walmart causing multiple injuries, Koch said.

DiBattista pled guilty on May 4, to third-degree assault by auto and pled guilty on June 17 to motor vehicle violation driving while intoxicated, Koch said.
