Man sentenced to probation for assault by auto in Sussex County
NEWTON, NJ (Sussex County) – A Sussex County man has been sentenced after pleading guilty to assault by auto, according to Acting Sussex County Prosecutor Annmarie Taggart.
Anthony Frato, Jr., 48, of Branchville Borough was sentenced on April 6 before the Honorable Michael C. Gaus, J.S.C. at the Sussex County Courthouse in Newton, Taggart said.
Frato Jr. was sentenced to 90 days Morris County Correctional Facility and 4 years probation. In addition to the standard conditions of probation, he must complete 200 hours of community service, random urine and drug screen, submit a DNA sample, Substance Abuse evaluation, follow all recommendations and pay $205 in fines and fees, Taggart said.
He had previously been sentenced on a related DWI charge in addition to the assault by auto charge. The DWI charge had a sentence of four months loss of license, an interlock required for twelve months, twelve hours of Intoxicated Driver Resource Center, and $690 in fines and fees, Taggart said.
Frato Jr. pled guilty on Feb. 1 third-degree assault by auto and driving while intoxicated. In pleading guilty, he admitted to driving under the influence of alcohol which subsequently led to the defendant striking the victim with his car, Taggart said.
Frato, Jr. was represented by Marty Morrison, Esq., and the State was represented by Special Deputy Attorney General and Acting Supervising Assistant Prosecutor Brent M. Rafuse.
