U.S. Senator Menendez celebrates President Biden’s signature of his bill to ease baby formula shortages

The bipartisan Bulk Infant Formula to Retail Shelves Act will further ease the infant formula shortages

NEW JERSEY – U.S. Senator Bob Menendez Tuesday celebrated the signature into law of his Bulk Infant Formula to Retail Shelves Act.

The bipartisan legislation, cosponsored by Sens. Mike Lee (R-Utah) Mike Braun (R-Ind.), and Todd Young (R-Ind.), will further ease the infant formula shortages by temporarily waiving tariffs on infant formula base powder, a key component of baby formula.

“I’m proud to have co-led this bipartisan effort in the Senate that has now being signed into law to make sure families in New Jersey and across the nation — especially those who are beneficiaries of nutrition programs — are not struggling to feed their babies,” Menendez said. “Lifting tariffs on a key baby formula component through the end of the year is a common-sense solution to help increase domestic manufacturing of this essential product.”

Back in February, one of the major producers of baby formula in the U.S. shut down its plant resulting in a nationwide formula shortage and highlighted significant problems in our regulatory process.

In May, reports showed that the national out-of-stock rate jumped to 74%. While reports show the stock rate has improved, many retailers are still limiting how much formula families can buy.

The Bulk Infant Formula to Retail Shelves Act continues the progress of the Fixing Our Regulatory Mayhem Upsetting Little Americans (FORMULA) Act, signed by President Biden in July, to help domestic manufacturers increase their production, thus further easing the formula crisis in the nation and ensuring that American babies don’t go unfed.
