LOPATCONG TOWNSHIP, N.J. (Warren County) — A Sussex County man was charged with driving while intoxicated after police stopped an erratic driver in Lopatcong Township last month, authorities said.

Police said they were called to Belvidere Road around 10:46 a.m. on July 31 after a report of a red Ford Expedition traveling at a high speed and passing another vehicle in a no-passing zone. Officers later located the vehicle on Charles Road.

The driver, identified as Nickolas A. Tice of Hopatcong Borough, was believed to be under the influence and failed field sobriety tests, according to police.

Tice was taken into custody and brought to police headquarters, where he refused to provide a breath sample for chemical testing, police said. He was charged with driving while intoxicated, refusal to submit to a breath test, open container of alcohol in a motor vehicle, consumption of alcohol in a motor vehicle, careless driving and failure to maintain lanes.

Tice was released pending a court appearance.
