Father charged in death of 2-month-old daughter in Warren County

LOPATCONG TOWNSHIP, N.J. (Warren County) — A Phillipsburg father has been charged in the death of his 2-month-old daughter following a 14-month investigation, according to the Warren County Prosecutor’s Office.

James A. Capo Jr., 39, was arrested Tuesday, June 23, and charged on a complaint warrant with first-degree homicide and second-degree endangering the welfare of a child.

Authorities said the charges stem from the death of his daughter, Sophia Capo.

Capo was lodged in the Warren County Correctional Center pending his first appearance in Warren County Superior Court.

According to prosecutors, Lopatcong Township police were dispatched at approximately 2:10 p.m. April 17, 2025, to the 700 block of Youngs Road for a report of an unresponsive 2-month-old infant who had reportedly fallen from a baby rocker.

Officers began lifesaving CPR before emergency medical services personnel transported the infant to St. Luke’s Hospital-Warren Campus.

Due to the severity of her condition, Sophia was later airlifted to Children’s Hospital of Philadelphia for advanced treatment. She died days later, on April 24, 2025.

The preliminary autopsy report listed the cause of death as “Blunt Injury of Head” and the manner of death as “Homicide,” according to the prosecutor’s office.

If convicted, Capo faces a maximum sentence of life in prison on the homicide charge. Second-degree crimes carry a maximum sentence of 10 years in New Jersey State Prison.

The investigation was conducted by the Lopatcong Township Police Department and the Warren County Prosecutor’s Office Major Crimes Unit. The Warren County Regional Crime Scene Team assisted at the scene.
