Pedestrian to receive summons after Chatham Borough crash investigation, police say

CHATHAM BOROUGH, N.J. (Morris County) — A pedestrian injured in a motor vehicle crash Tuesday at a Chatham Borough intersection will receive a summons after an investigation found the pedestrian’s actions contributed to the crash, police said.

Chatham Borough Police Chief Brian K. Gibbons said the department’s Traffic Safety Unit completed an investigation into the May 5 crash at the intersection of North Passaic Avenue and Weston Avenue.

According to police, the investigation included witness statements, physical evidence from the scene and a review of available dash camera footage.

Authorities said the evidence showed the pedestrian was running westbound across the north side crosswalk “similar to a jogger’s pace” while looking northbound and wearing earbuds when the pedestrian entered the roadway as a northbound vehicle entered the intersection.

Police said dash camera footage showed the driver taking immediate evasive action, including swerving into the southbound lane in an attempt to avoid the collision. Investigators determined the pedestrian struck the passenger side of the vehicle.

“As a result of the investigation, the pedestrian will be issued a motor vehicle summons related to actions that contributed to the crash,” Gibbons said in a statement.

Police said the investigation found no evidence of criminal or reckless conduct by the driver.

The crash generated significant public discussion and concern within the community, according to the department.

Although investigators determined the driver’s actions were not a contributing factor, borough officials said the intersection will still undergo a safety review involving the Chatham Borough Long-Range Traffic Safety Committee, borough engineering officials and Morris County engineering officials.

Police also said an issue involving the pedestrian crossing lights at the intersection had been identified before the crash and was already under review by the department’s Traffic Unit and a licensed electrician. Replacement parts for repairs had previously been ordered, authorities said.

“This incident serves as an important reminder that both motorists and pedestrians share responsibility for roadway safety,” Gibbons said.

Police said drivers should remain attentive and prepared for sudden hazards, while pedestrians should avoid distractions and ensure it is safe before entering a roadway.

Authorities said they wish the injured resident “a full and speedy recovery.”
